Disclaimer Policy for EBLO Pressure Cleaning

Effective Date: June 1st, 2025

1. Introduction

This Disclaimer Policy governs the use of high-pressure cleaning services (the "Services") provided by EBLO Pressure Cleaning (referred to as "we," "us," or "our"). By engaging our Services, you (the "Client") acknowledge that you have read, understood, and agree to the terms outlined in this policy.

This policy is intended to clearly define the scope and limitations of our liability in relation to the Services provided. We strive to deliver high-quality and safe cleaning solutions; however, inherent risks and variables are associated with high-pressure cleaning.

2. Service Limitations & Client Acknowledgements

  • Pre-Existing Damage: We will inspect the area(s) to be cleaned prior to commencing work and will bring any apparent pre-existing damage to your attention. However, we are not responsible for any damage that was present before our Services began, whether visible or hidden. High-pressure cleaning can sometimes reveal or exacerbate underlying issues (e.g., loose mortar, cracked pavers, flaking paint, poorly sealed surfaces) that were not immediately obvious.

  • Loose & Fragile Items: It is the Client's responsibility to remove all loose and fragile items from the areas to be cleaned prior to our arrival. This includes, but is not limited to, pot plants, garden ornaments, outdoor furniture, electronics, door mats, and any other items that could be damaged or displaced by water, cleaning solutions, or the pressure washing process. We will not be held liable for damage to such items if they are not removed.

  • Water & Chemical Usage:

    • Water Source: We will typically require access to a suitable water source on your property. It is the Client's responsibility to ensure this water source is functional and provides adequate flow. Any costs associated with water usage are the Client's responsibility unless otherwise agreed in writing.

    • Chemicals: We use industry-standard, approved cleaning solutions appropriate for the surfaces being cleaned. While we take care to select appropriate chemicals, we are not liable for unforeseen reactions with unusual or improperly sealed surfaces, or for effects on surrounding vegetation if specific protective measures were not requested or were impractical. Clients must inform us of any known sensitivities or specific material types that may require special consideration.

    • Run-off: While we endeavour to manage water run-off, we are not responsible for where water may pool or flow after the cleaning process, nor for any staining or damage caused by run-off containing dirt or cleaning residues, particularly on adjacent, unsealed, or porous surfaces not part of the agreed cleaning area.

  • Surface Integrity:

    • Painted and Stained Surfaces: High-pressure cleaning can remove loose, flaking, or poorly bonded paint or stain. We will use appropriate pressure levels, but we cannot guarantee that no paint or stain will be disturbed, especially on aged or weathered surfaces. We are not liable for the removal of such coatings unless it is due to our direct negligence in using excessive pressure for the known surface type.

    • Wood Surfaces: Wood is a natural material and can react unpredictably to pressure washing. While we aim to clean effectively, some "furring" or raising of the grain may occur, especially on softer woods. We are not responsible for this natural reaction.

    • Mortar and Pointing: Older or deteriorated mortar between bricks, pavers, or stones can be dislodged by high-pressure cleaning. We will exercise caution, but we are not liable for the dislodging of pre-existing loose or weakened mortar.

    • Window Seals & Glazing: While we take care when cleaning around windows, aged or deteriorated window seals may be compromised by pressure washing, potentially leading to water ingress. We are not responsible for damage to window seals or for water ingress resulting from pre-existing seal failure. Clients should ensure windows and doors are properly closed and sealed before work commences.

    • Oxidation Marks & Efflorescence: Pressure washing may not remove, and can sometimes make more apparent, issues like oxidation marks (e.g., from metal window frames), rust stains, or efflorescence (salt deposits from within masonry). We do not guarantee the removal of these types of stains.

  • Water Ingress: It is the Client's responsibility to ensure all windows, doors, vents, and other openings are securely closed and, where necessary, sealed to prevent water ingress into buildings or other structures. We are not liable for any water damage caused by unsealed or improperly closed openings.

  • Hidden Obstructions & Utilities: The Client must inform us of the location of any known hidden obstructions, underground utilities (e.g., pipes, cables), or delicate installations in or around the cleaning area. We will not be liable for damage to such items if their presence and location were not disclosed to us prior to the commencement of work.

  • Noise: High-pressure cleaning equipment can be noisy. Clients should make provisions for this, including informing neighbours if appropriate.

  • Plant & Garden Protection: We will take reasonable precautions to protect nearby plants and garden beds. However, some exposure to water spray or cleaning solutions may be unavoidable. We are not liable for minor damage to plants unless specific, agreed-upon protective measures were not implemented by us. Clients should point out any particularly sensitive or valuable plants for special attention.

  • Drying Times & Results: The appearance of cleaned surfaces may change as they dry. Full results may not be apparent until the surface is completely dry. Streaks or lines can occasionally occur due to uneven drying, surface porosity, or pre-existing conditions, and we do not guarantee a perfectly uniform finish on all surface types.

3. Limitations of Liability

  • To the maximum extent permitted by Australian Consumer Law, our liability for any claim, loss, damage, or expense arising out of or in connection with our Services (whether in contract, tort including negligence, statute, or otherwise) is limited to:

    • Re-supplying the Services; or

    • The cost of having the Services re-supplied.

  • We are not liable for any indirect, consequential, or incidental loss or damage, including but not limited to loss of profit, loss of use, or damage to property not directly part of the agreed cleaning area, unless such loss or damage was a direct result of our gross negligence.

  • Our total aggregate liability for all claims arising out of or in connection with a specific job or Service engagement shall not exceed the total fee paid by the Client for that specific job or Service.

4. Client's Responsibility to Inspect & Report

The Client or their representative should inspect the completed work with our operator before they leave the site, if possible. Any concerns or issues should be raised immediately. If the Client is not present upon completion, any concerns or claims regarding the Services must be reported to us in writing (email acceptable) within 48 hours of the Service completion. Failure to report issues within this timeframe may limit our ability to investigate and address the concerns.

5. Quotations & Scope of Work

Our quotations are based on the information provided by the Client and our initial assessment of the work required. If the scope of work changes, or if unforeseen circumstances or conditions are encountered that significantly alter the work required, we reserve the right to amend the quotation and will seek your approval before proceeding with any additional work.

6. Payment

Payment for Services is due upon completion of the work, unless otherwise agreed in writing. Failure to make timely payment may result in additional charges or collection costs.

7. Photography & Marketing

We may take photographs or videos of the work area before, during, and after the Services for our internal records, quality control, and marketing purposes (e.g., website, social media). No personally identifiable information of the Client will be used without explicit consent. If you do not wish for images of your property to be used, please inform us in writing before the Services commence.

8. Amendments

We reserve the right to amend this Disclaimer Policy at any time. The most current version will be available on our website or can be provided upon request. Your continued engagement of our Services after any amendments constitutes your acceptance of the revised policy.

9. Governing Law

This Disclaimer Policy shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from this policy or our Services will be subject to the exclusive jurisdiction of the courts of Victoria.
